1. Acceptance
These Terms govern every bicycle rental, booking, delivery, pickup and related service provided by Roads Queen (“RQ”, “we”, “us” or “our”). By booking online, making payment, accepting by OTP/checkbox/electronic confirmation, signing, or taking possession of a bicycle or equipment, the customer (“Rider”, “you” or “your”) agrees to these Terms, the applicable Booking Confirmation and any published rental, damage or cancellation policy.
2. Eligibility & Verification
Independent rental is available only to riders aged 18 years or above unless RQ expressly permits otherwise.
RQ may require government ID/KYC, photograph/selfie, mobile number, address and emergency-contact details before handover.
RQ may refuse or cancel a rental where KYC is incomplete, false, unverifiable or where there is a reasonable safety/security concern.
3. Booking & Payment
A booking is confirmed only after RQ receives the required payment/information and confirms the booking.
Rental charges, taxes, security deposit and other disclosed charges must be paid through authorised RQ payment channels.
Availability is not guaranteed by an enquiry, quotation or tentative reservation.
The applicable Booking Confirmation, pricing, cancellation and damage policies form part of these Terms.
4. Handover & Condition
At handover, RQ may record the bicycle/equipment IDs, replacement value, condition, photographs/videos and other operational details. The Rider must inspect the bicycle and report visible damage, missing items or safety concerns before riding. Existing damage recorded by RQ will not be charged to the Rider unless additional damage is caused during the rental.
5. Safe & Lawful Use
The Rider confirms that they can safely operate the bicycle and will ride within their skill and ability.
All applicable Indian laws, traffic rules, signals, police directions and route restrictions must be followed.
Do not ride under the influence of alcohol, drugs or any impairing substance; race or perform stunts; ride freehand; use a handheld phone while riding; carry another person unless the bicycle is designed for it; hold onto moving vehicles; or use the bicycle for unlawful or dangerous purposes.
The bicycle may be used only by the registered Rider, during the agreed rental period and within permitted areas.
6. Prohibited Use
No sub-renting, lending, transfer, commercial delivery/courier use, paid passenger carriage or onward hire without RQ's written approval.
No unauthorised modification, dismantling, repainting, tampering with locks or removal of installed equipment.
No use outside the city or in areas specifically restricted by standard traffic norms.
7. Care, Security & Parking
Responsibility for the bicycle and all supplied equipment passes to the Rider at handover and continues until proper return and acknowledgement by RQ. When unattended, the bicycle must be legally parked, locked with the supplied/approved lock and secured against theft or damage wherever reasonably possible. The Rider must protect keys, access credentials and security equipment.
8. Theft, Loss, Damage & Replacement
The rider must immediately report any theft, loss, abandonment, serious damage, or non-return of the bicycle to RQ and cooperate with reasonable recovery procedures, including filing a police report where applicable.
The rider may be liable for reasonable repair, recovery, transport, or replacement costs resulting from negligence, misuse, unauthorised use, reckless riding, intentional damage, or breach of these Terms. Normal wear and tear is not chargeable.
If the bicycle is lost, stolen, not returned, or seriously damaged beyond repair, the rider must pay the bicycle’s prevailing market/replacement value before the subscription period ends.
9. Breakdown & Accidents
If a mechanical problem makes riding unsafe, stop riding, move to a safe location where possible and contact RQ promptly.
Do not undertake major repairs or permit unauthorised repairs without RQ approval, except where reasonably necessary in an emergency.
After an accident, prioritise safety and emergency assistance, comply with legal requirements, inform RQ as soon as reasonably practicable and provide truthful incident details and photographs where safe.
10. Cycling Risks & Liability
Cycling involves inherent risks including falls, collisions, traffic, potholes, uneven surfaces, weather, pedestrians, animals, mechanical issues, serious injury and death. The Rider voluntarily accepts these inherent risks and remains responsible for their conduct and use of the bicycle. To the maximum extent permitted by law, RQ is not responsible for loss, injury or damage arising solely from the Rider's negligence, misconduct, unlawful conduct, intoxication, unauthorised use or failure to follow safety instructions. Nothing in these Terms excludes or limits liability or statutory consumer rights that cannot legally be excluded.
11. Third-Party Claims & Indemnity
To the extent permitted by law, the Rider is responsible for third-party injury, death, property damage or claims caused by the Rider's negligence, unlawful conduct, intentional misconduct, unauthorised use or material breach. The Rider agrees to indemnify RQ against resulting third-party claims and reasonable expenses, except to the extent caused by RQ's own legally attributable liability.
12. Rental Period, Return & Late Return
The rental period begins at handover and ends only when the bicycle and all equipment are returned to the agreed RQ location/representative and the return is acknowledged.
Expiry of the rental time, leaving the bicycle unattended, sending a photograph or handing it to an unauthorised person does not constitute valid return.
Late-return charges, extension terms and recovery charges, where applicable, are those disclosed at booking. Continued possession without RQ approval is not an automatic extension.
RQ may inspect the bicycle after return and notify the Rider of damage or missing items that could not reasonably be identified at handover.
13. Security Deposit
Where applicable, the refundable security deposit may be adjusted against legitimate outstanding rental charges, late fees, missing equipment, reasonable damage/repair, replacement or recovery costs, subject to applicable law and the disclosed booking policy. Any undisputed balance will be returned within the communicated timeline after closure and inspection.
14. Cancellation, Refunds & RQ Substitution
Cancellation, no-show, refund and weather/safety terms are governed by the policy displayed and accepted at booking. RQ may substitute a reasonably equivalent bicycle or, where it cannot provide a confirmed rental, offer rescheduling, credit or refund as applicable. Statutory consumer rights remain unaffected.
15. Suspension & Termination
RQ may refuse, suspend or terminate a rental where reasonably necessary for safety, bicycle security, suspected unlawful use, material breach, intoxication, false KYC, non-payment or serious operational/security concerns. Termination does not remove accrued payment, return, damage, loss or other lawful obligations.
16. Force Majeure
RQ is not responsible for delay or non-performance caused by circumstances beyond reasonable control, including extreme weather, flooding, natural disasters, government restrictions, road closures, civil disturbance, strikes, transportation disruption or similar events. Applicable statutory rights remain unaffected.
17. Complaints, Law & Jurisdiction
Customers should first contact RQ with booking details and supporting information so that RQ can investigate and attempt an amicable resolution. These Terms are governed by Indian law. Disputes are subject to the jurisdiction of courts/authorities having lawful jurisdiction, subject to mandatory consumer rights and applicable law.
18. Electronic Acceptance
Acceptance may be by signature, checkbox, OTP, online booking, email/WhatsApp confirmation or another electronic method used by RQ. Electronic records of booking, payment, KYC, acceptance, handover, photographs, communications and return may be maintained and relied upon subject to applicable law.
